Appeals court rules against city of Double Horn in state AG lawsuit

As city of Double Horn citizens prepare to vote in the Nov. 5 election on whether to remain incorporated, the Texas Court of Appeals, Third District released an opinion Oct. 30 that allows the state AG's office to proceed with a lawsuit aimed at dissolving the municipality.

The Texas Third District Court of Appeals ruled in favor of the State Office of the Attorney General (OAG) on Oct. 30 in the entity's effort to advance trial proceedings seeking to dissolve the city of Double Horn on allegations the municipality formed unlawfully in an effort to halt a quarry operation.

Double Horn alderman resigns citing conflict of interest

The city of Double Horn faces more changes in the wake of an alderman resignation, an upcoming vote by the citizens to potentially dissolve the city and a pending appeal by the state attorney general's office, challenging the city's incorporation.

An alderman for the city of Double Horn has resigned saying remaining on the council would be “a conflict of interest,” in light of his support for dissolving the municipality.

The resignation of Robert “Bob” Link comes after the validation of an election, Nov. 5, for a vote which could determine the fate of the city's incorporation.

“I resigned my position on the Double Horn council because I believe I have a conflict of interest with the council,” Link said.

State of Texas sues city of Double Horn for incorporating to block mining

The city of Double Horn will face attorneys with the State of Texas who alleged that the newly-created municipality formed with the sole purpose of attempted regulation of a proposed 280-acre mining operation on Texas 71 adjacent to community. The state of Texas has launched a lawsuit against the newly-incorporated city of Double Horn, claiming the community failed to follow state law in the process of becoming a municipality in its pursuit to regulate an adjacent mining operation.

A hearing in the Burnet County district court is scheduled April 3 before 424th Judicial District Judge Evan Stubbs.

Burnet County has a new county auditor and purchasing agent after 33rd District Judge Allan Garrett and 424th District Judge Evan Stubbs appointed Karin A. Smith to the position, effective Feb. 4.
